1. Definitions and Scope
In these terms and conditions, the following definitions apply:
a. “Tour Operator”: AuthenticPura Travel and all companies cooperating with AuthenticPura Travel for your trip;
b. “Travel Agreement”: the agreement in which the tour operator undertakes to provide the counterparty with a pre-organized trip including at least one overnight stay or a period of more than 24 hours, as well as at least two of the following services: 1. accommodation, 2. transport, 3. another tourism-related service not associated with transport or accommodation that constitutes a significant part of the trip.
c. “Traveler”: 1. the counterparty of the tour operator, 2. the person for whom the trip has been arranged and who has accepted this arrangement, or 3. the person to whom, in accordance with Article 7:506 of the Dutch Civil Code, the legal relationship with the tour operator has been transferred, as well as 4. the representative(s), authorized person(s), legal successor(s), and/or heirs of the persons mentioned in points 1 to 3.
d. “Force Majeure”: abnormal and unforeseeable circumstances beyond the control of the party invoking them, the consequences of which could not have been avoided despite all precautionary measures. Examples include mechanical failure, natural disasters, strikes, changes in departure and/or arrival times, war, fire, and government regulations.
e. These terms and conditions apply, unless otherwise agreed, to all travel agreements concluded with the tour operator, including self-arranged transport trips and shuttle trips by bus. The tour operator may stipulate that these conditions also apply to other agreements concluded with them. Deviations from these conditions are only valid if agreed upon in writing with the tour operator. These conditions also apply to travel agreements with the tour operator where third parties are involved in the execution. If any provision in these terms and conditions or in the travel agreement is deemed void or annulled, the remaining provisions will remain in effect. The void provision will be replaced by a provision that most closely matches the intent of the original provision.
2. Formation and Content of the Agreement
a. The travel agreement is concluded when the tour operator’s offer is approved. AuthenticPura Travel reserves the right to refuse a booking without stating reasons. Since AuthenticPura Travel operates as an online travel agency and communicates solely via email, the traveler’s email confirmation of an offered trip is binding once received and confirmed by AuthenticPura Travel. Approximately 8 days after the confirmation, the traveler will receive a booking confirmation/invoice by email. This document is merely a confirmation of the purchase agreement.
b. The person entering into a travel agreement on behalf of or for another traveler is jointly liable for all obligations arising from the agreement. The (other) traveler(s) is/are individually liable for their own part. The traveler entering into the agreement must disclose relevant personal circumstances (such as age and health status) that may affect the execution of the travel agreement.
c. Verbal commitments, telephone reservations, and later additional agreements are not binding unless confirmed in writing by the tour operator.
d. The traveler may express preferences regarding the execution of the travel agreement (e.g., specific airplane seats or non-smoking sections), and while the tour operator will consider these as much as possible, no rights can be derived from such commitments, even if noted on travel documents. The tour operator’s obligation is limited to a best-effort commitment.
3. Payment
a. Upon conclusion of the travel agreement more than six weeks before departure, the traveler must make a down payment of 25% of the total travel sum (minimum €75 per person) via bank transfer. Credit card payments are not accepted.
b. The remaining balance must be paid no later than six weeks before departure.
c. If the agreement is concluded within six weeks before departure, the full travel sum must be paid immediately.
d. In the event of non-payment or late payment, the traveler is in default and will be notified accordingly. If payment is not received within seven days, the tour operator has the right to cancel the agreement and charge applicable cancellation fees as specified in Article 7.
4. Travel Sum
a. Published/offered travel prices are per person, in Euros, and include VAT and other taxes. Prices are based on rates, exchange rates, and conditions known at the time of publication.
b. The tour operator may increase the travel price up to 15 days before departure due to changes in transport costs, taxes, or exchange rates.
c. If the price increase exceeds 15%, the traveler has the right to cancel the agreement within eight days and receive a full refund.
d. Travel insurance, luggage insurance, and cancellation insurance are not included in the travel price. The tour operator requires travelers to have travel and accident insurance and advises purchasing cancellation insurance.
5. Traveler Obligations, Travel Documents, and Luggage
a. The traveler must have a valid passport and any required visas or vaccinations. Failure to obtain required documents is at the traveler’s own risk.
b. The traveler must follow all instructions from the tour operator to ensure smooth trip execution and is liable for damages caused by misconduct.
c. The traveler must confirm the exact departure time for the return trip 24 hours in advance.
d. The tour operator is not liable for loss, damage, destruction, or theft of luggage or travel documents.
6. Changes by the Traveler
a. The traveler may request changes to the travel agreement up to 28 days before departure. A decision will be communicated within seven days. A change fee of €125 plus communication costs applies.
7. Cancellation Fees
a. The tour operator advises purchasing cancellation insurance and requires travel insurance.
b. Cancellations must be submitted by email and confirmed by AuthenticPura Travel.
c. Cancellation fees:
- Up to 42 days before departure: 25% of the travel sum.
- From 42 to 28 days before departure: 35% of the travel sum.
- From 28 to 14 days before departure: 50% of the travel sum.
- From 14 days to departure day: 100% of the travel sum.
8. Changes to Activities
Due to organizational or weather conditions, certain activities may be modified or canceled. An alternative will always be offered.
9. Cancellation by the Tour Operator
a. The tour operator may cancel the agreement due to significant circumstances and will offer an alternative or a refund.
b. The tour operator may cancel in cases of force majeure (e.g., war, natural disasters, epidemics, strikes) without liability.
10. Tour Operator Responsibilities and Liability
a. The tour operator is responsible for executing the travel agreement but is not liable for damages caused by the traveler, third parties, or circumstances beyond its control.
b. The tour operator is not liable for losses covered by travel or cancellation insurance.
11. Complaints
Complaints about the trip must be reported immediately to the guide or local representative to allow resolution.
